Since Senate passed the CIR bill last year, is it necessary for the Senate to pass a bill again this year?
If the House manages to pass CIR this year, wouldn't a committee (Senate & House members) meet and chalk of the difference and come to a common ground?
Pending legislation from last year were part of a different congress (house+senate), and all bills from last congress, that failed to become law, expired at the beginning of this year when a new Congress took charge. That's why CIR is being re-introduced in both the house and senate.
If the House manages to pass CIR this year, wouldn't a committee (Senate & House members) meet and chalk of the difference and come to a common ground?

One of my friend is working on L1 visa in chicago. He has approved H1b from last year. He is planning to go for stamping in mexico. Question is, After H1B stamping can he work for same company on L1? Forgive me if it is stupid question.

I'll give you a honest answer. Consult an attorney and find a fool proof step, if there is one. Although, I'm inclined to say, stay F1 and bring her as F4. You need much more than that.

Thanks for reading this message. Since you are from mid-west, you are capable of taking your car and drive in the direction of DC. It will take anywhere from 9-15hours. But you will be able to do it.
If there was a possibility of USCIS handing a GC in person, you would have driven 50 hours. Can you not drive for 10hours for a cause that is affecting you, me and everyone around us?
Now make up your mind and drive and meet other mid-westerners in DC.
I know one mr Gan*** - who flew to Nebraska with a Substitute labor and i 140 petition on the last day before labor substitution was banned. Mr Gane** also filed for 485 after the fiasco and we had a drink together because he thought he did a marvellous job as he is just 2 months old in US and has just landed in a consulting job and already applied 140/485 during the fiasco.
But he is not willing to hop onto my car, lives 5 miles from my place in Queens, to go to DC.
This shows the poor attitude people have towards grassroots efforts.

My 6th year on H1 ends Dec 2007. My PERM LC is pending and the lawyer is confident I won't run into problems. My question is after 6 years on H1 can I switch to H4 since my husband is on H1? Or if 6 years max given for an H visa?

I had recently applied for my 5 yr old son for passport renewal at washington DC embassy, as we fall under their jurisdiction and got the new passport.
I had mailed all the documents and it took around 1 months to get the passport.

My Personal experience was:
- When my H1B was filed for the first time it had a wrong Date of Birth, lawyer asked me to bring Birth Certificate to the Interview at the consulate. I did not have problems with the stamping of the visa.
When my extension was filed , again, Date of Birth was wrong. Lawyer told me the same thing. Get recent Birth Certificate and bring it to the Interview.
Did not have any problem at all.

I lost my job about a month ago with fortune company where I had my H1 and then I filed to transfer my H1 to the GC filing company. It got approved last week. They even seem to have sent the I 94 with the H1 approval.
I have a visa from the earlier company(fortune company) till dec 2009 in my passport. Do I now need to get a fresh visa again with the new (GC) company that has sponsored my H1. Or is the visa validity in my passport is good enough to work even for the new employer?

I have completed 3.5 years of my H1B and am looking at the possibility of applying for GC either under EB2/3.
After my 12th, I did a 2 year Diploma in Business from Australia and then did a 2 year MA(History) in correspondence (open uni) from India and also a 1 year PGDCA by correspondence.
I have more than 10 years of IT experience to go with my 12+2(fulltime)+3(correspondence)years of education.
Questions:
Please advice if I qualify for EB2 and if so will there be any issues ?

The challenging thing here for your attorney is to provide proof that you have ABET 4-yer bachelor or equivalent degree before filing i-140. Even EB3 is going to be challenging task. Remember H1B requirements are different from EB green card.:(

Consult a good lawyer, prepare an appropriate reply based on true situation. If they feel that the request is genuine, they will approve else be prepared for the worst.
To be frank, i don't think any company like the one you explained even exists! I will be surprised if it does, and if it does I won't wonder if there is no RFE in the current enforcement days from USCIS.

My wife recently went for a H1B renewal stamping in india. They visa officer provided a 221(g) administrative processing (pink) requesting additional documents (job description, reasearch projects, previous visas list etc..,). She is preparing the necessary docs to submit the same. Since she went to india for a short trip (travelling back next week).
1. She has Advanced parole. Can we use Advance parole??
2. If we use Advance parole, then once the Adminstrative processing is complete, how do we handle the stamping?? Do we need to go back again to the consulate to get the stamping done? or is there a way to withdraw the visa application from the consulate??
I would greatly appreciate if someone is similar situation share their experiences

we then refiled a second i-140, but processing was stopped on that because they needed the original labor cert. from my first i-140.
i filed on 19th May, and finally got approved on 27th July, although i did file PP.
So i would say a couple of months is about right for the labor cert. to be transferred from one case to another.

I have a big problem that I got approved on the H1 Recapture to get back into US on January 15, 09 though my attorney screwed up by putting someone else background into the Petition Letter submitted to USCIS with my application. The petition letter to USCIS is all wrong. It states the wrong education, work experience and job duty. They put somebody else background into mine. They put the correct sponsoring company on the first page of the letter though at the end of the second page they put the wrong sponsoring company. In this case, what should I do and what should I answer at the US Consular in Malaysia to get my H1 Visa? What should I do now? Please advise. Do I have to resubmit the application back to USCIS? Will I get rejected? Please help. Thank you very much.
